When a notary public accepts money, deeds or documents in the role of a trustee, he is required to respect special guidelines and also provide extensive insurance cover within the scope of legally required professional indemnity insurance.

INDEPENDENCE

The notary public is an official post, but he is independent from the state and exercises his profession under his own name and on his own account. He is not subject to any state instructions. The performance of the office of a notary public is regularly monitored by the notarial chamber.

Impartiality

As is the case with judges, notary publics are obligated to be impartial. A notary public does not represent only the interests of a client. He must attempt to achieve balanced legal and contractual relationships in order to avoid conflicts in advance and to create reliable and sustainable legal relationships.

Confidentiality

A notary public and his staff are fully obligated to respect the confidentiality of all parties. This obligation to maintain confidentiality essentially applies to all matters in which the notary public is involved in the performance of his office. Information may only be disclosed to third parties subject to the explicit approval of all parties involved.

Professional profile

The notary public is an official post which accords the holder the authority to prepare public deeds. As such, the notary public ensures the authenticity, conclusiveness, safeguarding and the enforceability of these deeds. The notary public is obligated by law to be impartial and objective and is accredited with public reliance.

Notarial deeds are accorded particular conclusiveness both in court and by public authorities. Notarial deeds can also be equally as enforceable as legal decisions.

Notary publics are subject to particular supervision and strict disciplinary rules. As such, a notary public represents neither party in a legal case, representing instead the law itself. He helps the parties to secure their rights, prevents disputes and mediates in cases where more can be reached through compromise rather than through court decisions.

The notary as a court commissioner

One of the most important tasks of a notary public is to act as an agent on behalf of a court of law (i.e. as a court commissioner). In this role, the notary public performs jurisdictional tasks and acts with sovereign authority.

The most common and most important task as a court commissioner is to execute probate proceedings, which are automatically initiated after every death in Austria.

Notary publics are appointed by law to execute the probate proceedings on behalf of the courts. It is in this role that the notary public acts as a so-called court commissioner. This involves performing certain specific obligations and tasks.
